Frequently asked questions
How does the property purchase process work in Spain?
Viewing → reservation contract and taking the property off the market → the lawyer's legal checks → purchase contract and down payment → notarised completion and key handover. Our team guides you the whole way.
Can I buy remotely?
Yes — with a power of attorney granted to your lawyer, all documents can be signed remotely, and we arrange viewings by video call.
The property is safely taken off the market
A formal agreement protecting both parties
The reservation contract is standard procedure in Spain. It takes the property you want off the market for a set period while your lawyer performs all the necessary legal checks.
The reservation contract sets out the key terms of the proposed purchase and the conditions for paying or refunding the deposit. It is signed by both parties — the buyer and the seller.
Frequently asked questions
What is a reservation contract?
A standard agreement that takes the property off the market for an agreed period while the lawyer performs checks. It records the price, deadlines and deposit terms.
Is the reservation fee refundable?
If the lawyer's checks reveal legal obstacles, the reservation fee is normally refunded — this is set out in the contract terms.
Every step — safe and clear
Legal checks and the down payment
Your lawyer will carry out due diligence on the purchase documents and provide you with a detailed report of their findings, together with an overview of all purchase costs.
If the documents are in order, your lawyer will arrange the signing of the purchase contract, after which the down payment is made to the seller. The completion and handover date is also agreed.
Frequently asked questions
Do I need a lawyer when buying property in Spain?
Strongly recommended: the lawyer verifies title documents, developer licences and bank guarantees, prepares the contracts and represents you until completion.
Are payments to the developer safe?
For new builds the developer must hold a bank guarantee covering your instalments — this is verified before signing the contract.
Contract and costs — fully transparent

The purchase contract is the agreement between buyer and seller establishing the terms of the purchase. It is prepared by your lawyer.
When buying a new-build home, total acquisition costs come to around 13.5% of the purchase price. These charges can vary slightly by location and property value.
